1. Agreement to Terms

APIMart (apimart.ai) is operated by 杭州唤智网络科技有限公司("APIMart", "we", "us" or "our"). APIMart is a one-stop AI API aggregation platform. Through a unified, OpenAI-compatible API, we provide developers and businesses with stable, cost-effective access to mainstream AI models across text, image, video, and audio generation.

Our mission is to make cutting-edge AI infrastructure accessible to every team. With transparent pay-as-you-go billing, high-availability intelligent routing, and professional technical support, APIMart powers thousands of applications worldwide.

By accessing and using APIMart (apimart.ai), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our service or use our API.

2. Description of Service

APIMart provides a unified AI API platform that allows developers to access a wide range of third-party AI models — including chat (large language) models, image generation models, and video generation models — through a single integration point. The specific models available, together with their capabilities and pricing, are listed on our website and in our API documentation. Because the underlying models are developed and operated by third-party providers, the catalog may change from time to time: models may be added, updated, renamed, or retired without prior notice. Our language model (chat) APIs follow an OpenAI-compatible request format to simplify integration; image and video generation APIs use their own request formats as described in the API documentation.

3. User Accounts and API Keys

When you create an account with us, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your account, password, and API keys. You must not share your API keys with unauthorized parties or use them in ways that violate these terms.

4. Acceptable Use

You agree not to:

  • Use the API service for any illegal purposes or in violation of applicable laws
  • Violate any intellectual property rights or third-party rights
  • Send malicious code, viruses, or attempt to compromise our API infrastructure
  • Attempt to gain unauthorized access to our systems, other users' accounts, or API keys
  • Use our APIs to generate inappropriate, harmful, illegal, or abusive content
  • Use our AI models to create deceptive, misleading, or fraudulent content
  • Exceed rate limits or attempt to bypass usage restrictions
  • Resell, redistribute, or white-label our API services without explicit authorization
  • Share your API keys publicly or use them in client-side code where they can be exposed
  • Scrape, reverse engineer, or attempt to extract our AI models

5. Content Rights and Data Usage

You retain all rights to your input data and generated outputs. By using our service, you grant APIMart a limited license to process your API requests, inputs, and temporarily store generated outputs solely for the purpose of providing our AI API services to you. We do not use your data to train AI models or share it with third parties except as necessary to provide the service.

6. Payment Terms and Billing

APIMart operates on a pay-as-you-go pricing model. You agree to pay all fees according to the pricing established on our website for API usage. Billing is based on actual API requests and tokens consumed. You are responsible for monitoring your usage and managing your spending limits. Volume discounts are automatically applied where applicable. Refunds are handled in accordance with Section 7 (Refund Policy) below.

Credits. Platform services are accessed using Credits, a virtual unit used within the platform. Credits may be used solely to redeem AI services on the platform. Credits are not a fiat-currency balance; they bear no interest and, except for refunds expressly allowed under Section 7 (Refund Policy), cannot be withdrawn, exchanged, or redeemed for cash. The amount of Credits required to use a given model or channel is determined by APIMart and may be adjusted dynamically based on the model, the upstream provider channel, or operating costs.

7. Refund Policy

This section sets out our refund policy for credit purchases and account balance on APIMart:

  1. Unused balance. If you are not satisfied with the service, you may request a refund of the unused balance remaining in your account within 7 days after a top-up. Approved refunds will be returned to the original payment method.
  2. Consumed usage. Credits or balance that has already been consumed by API calls is non-refundable, because actual compute costs are incurred when each request is made.
  3. Promotional credits. Credits granted through promotions or rewards have no cash value and are not eligible for refunds.
  4. Processing time. After a refund request is approved, it will generally be completed within 5–10 business days. The time for funds to appear in your account depends on your bank or card issuer and may take longer.
  5. How to request. Send an email from your registered account email to [email protected], including your order number and the reason for the refund. We will reply within 24 hours on business days.
  6. Service outages. If a sustained service failure is caused by the platform itself, please contact us at [email protected]. We will evaluate compensation or refunds on a case-by-case basis.

8. Service Availability and SLA

While we strive to provide 99.9% uptime and uninterrupted API service, we do not guarantee that our services will be available at all times. Scheduled maintenance will be announced in advance when possible. We reserve the right to modify, suspend, or discontinue any API endpoint, AI model, or feature at any time, though we will make reasonable efforts to provide notice for significant changes. Rate limits and usage quotas may be adjusted as needed to maintain service quality.

9. Limitation of Liability

APIMart shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the API service, including but not limited to loss of data, loss of profits, or service interruptions. Our total liability shall not exceed the amount you paid to APIMart in the three months preceding the claim. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

10. Intellectual Property

The APIMart service, including its API documentation, platform features, and functionality, is owned by APIMart and is protected by international copyright, trademark, and other intellectual property laws. The underlying AI models are owned by their respective providers. You may not copy, modify, distribute, or create derivative works based on our API platform without explicit permission.

11. Termination and Suspension

We may terminate or suspend your account, API keys, and access to the service immediately, without prior notice, for any breach of these Terms of Service, including but not limited to: violation of acceptable use policies, fraudulent activity, non-payment of fees, or excessive abuse of the API. Upon termination, your right to use the API will immediately cease, though you remain liable for any outstanding charges.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. For significant changes affecting API functionality or pricing, we will provide advance notice via email to registered users. Your continued use of the API after changes take effect constitutes acceptance of the modified terms.

13. API-Specific Terms

By using APIMart's API, you acknowledge that: (a) API responses are generated by third-party AI models and may not always be accurate or appropriate; (b) you are responsible for reviewing and validating all API outputs before use in production; (c) rate limits and quotas apply to all API endpoints and may vary by plan; (d) we may cache certain responses for performance optimization; (e) you must comply with the terms and conditions of the underlying AI model providers.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. Any dispute arising out of or in connection with these Terms or your use of the API service shall be submitted to the jurisdiction of the people's courts in Hangzhou, Zhejiang Province, China, unless mandatory consumer protection laws in your place of residence require otherwise. You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits, except where prohibited by applicable law.

Local compliance for AI services. APIMart provides API access to third-party AI models for chat, image generation, and video generation to users worldwide. You are responsible for ensuring that your access to the service and your generation, use, and distribution of AI-generated content (including text, images, and videos) comply with the laws and regulations of your own jurisdiction — for example, rules on labelling or disclosure of AI-generated content, data protection and privacy laws, and content restrictions. If the laws of your jurisdiction prohibit the use of AI generation services, you may not use APIMart.

Export control and sanctions. You may not access or use the service in violation of applicable export control or economic sanctions laws, and you represent that you are not located in, or acting on behalf of any party located in, a jurisdiction subject to comprehensive sanctions or otherwise prohibited from receiving the service.

Consumer rights and language. Nothing in this section deprives you of any mandatory consumer protection rights under the laws of your country of residence. These Terms are drafted in English; if any translation is provided for convenience, the English version prevails.
